Under the Trading with the Enemy Act of 1917 ("TWEA"), starting with Franklin D. Roosevelt in 1933, presidents had the power to declare emergencies without limiting their scope or duration, without citing the relevant statutes, and without congressional oversight.[1] The Supreme Court in Youngstown Sheet & Tube Co. v. Sawyer limited what a president could do in such an emergency, but did not limit the emergency declaration power itself. A 1973 Senate investigation found (in Senate Report 93-549) that four declared emergencies remained in effect: the 1933 banking crisis with respect to the hoarding of gold,[2] a 1950 emergency with respect to the Korean War,[3] a 1970 emergency regarding a postal workers strike, and a 1971 emergency in response to inflation.[4] Title V, Section 502 of P.L. 94-412 specifically exempts the statutorily authority cited in the Proclamations of these four declared states of national emergency from termination. It then passed the International Emergency Economic Powers Act to restore the emergency power in a limited, overseeable form.

The United States is in a perpetual state of national emergency.

Thirty separate emergencies, in fact.

An emergency declared by President Jimmy Carter on the 10th day of the Iranian hostage crisis in 1979 remains in effect almost 35 years later.

A post-9/11 state of national emergency declared by President George W. Bush — and renewed six times by President Obama — forms the legal basis for much of the war on terror.

Tuesday, President Obama informed Congress he was extending another Bush-era emergency for another year, saying "widespread violence and atrocities" in the Democratic Republic of Congo "pose an unusual and extraordinary threat to the foreign policy of the United States."

The most senior officer to be relieved Monday was Col. Carl Jones, the No. 2 commander of the 90th Missile Wing at F.E. Warren Air Force Base, Wyoming, in charge of 150 of the Air Force's 450 Minuteman 3 nuclear intercontinental ballistic missiles. He was dismissed "for a loss of trust and confidence in his leadership abilities," and has been reassigned as a special assistant to the wing commander. The actions Monday were confirmed to The Associated Press in response to an AP inquiry about an internal Air Force investigation of two commanders at the 91st Missile Wing at Minot Air Force Base, North Dakota, which also is responsible for 150 Minuteman 3 missiles. It is unusual for disciplinary action to be taken against senior officers at two of the Air Force's three nuclear missile bases on the same day. Officials said the timing was a coincidence. It extends a pattern of leadership failures in the ICBM force over the past year. Last March nine officers were fired at Malmstrom Air Force Base, Montana, which is the third of the three nuclear missile bases, in response to an exam-cheating scandal there. Last year, Maj. Gen. Scientists testing for card fraud on new contactless microchip debit and credit cards have found a critical flaw that could allow a criminal to steal up to $1 million just by coming into close contact with a person.

During a presentation at the ACM Conference on Computer and Communications Security in Arizona on Monday, Newcastle University scientists presented a paper that showed flaws in microchip credit and debit cards. With the new microchip cards, users can just swipe the chip for transactions up to $31, for speed and convenience.

However, researchers found the chips do not recognize limits with foreign currency transactions. Just by pre-setting the amount you want to transfer on a mobile phone, all it takes is a bump against another person’s pocket – where the card can communicate with something like a smartphone – to approve the release of hundreds of thousands in foreign currency. In tests conducted, these types of transactions took less than a second to be approved.
